DMCA / Copyright Policy

ZipThrifter respects intellectual-property rights and expects everyone who uses the platform to do the same. Stores, creators, and shoppers post content (listing photos, descriptions, videos, reviews). If you believe content on ZipThrifter infringes your copyright, this page explains how to send a takedown notice, and how a user can dispute one.

1. Overview

ZipThrifter hosts user-generated content, including store listings, item photographs, Hype Rack videos, store profiles, reviews, and comments. We do not pre-screen this content for copyright ownership. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and will promptly remove or disable access to content that is the subject of a valid takedown notice.

2. Designated Copyright Agent

Send DMCA notices and counter-notices to ZipThrifter’s Designated Agent:

  • Designated Agent: ZipThrifter Copyright Agent

Note: a complete designated-agent mailing address will be published here and registered with the U.S. Copyright Office. Until then, email is the fastest way to reach us about a copyright concern.

3. How to File a Takedown Notice

If you are a copyright owner (or authorized to act for one) and believe content on ZipThrifter infringes your work, send a written notice to the Designated Agent above that includes all of the following (these elements are required by 17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed (or, for multiple works, a representative list).
  • Identification of the material you claim is infringing, with enough detail for us to locate it, ideally the listing URL, Store name, or video link on ZipThrifter.
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Submitting a false or bad-faith notice may expose you to liability for damages (including costs and attorneys’ fees) under 17 U.S.C. § 512(f). If you are unsure whether something is actually infringing, consult a lawyer before filing.

4. What Happens After a Valid Notice

  • We will remove or disable access to the identified content promptly.
  • We will make a reasonable effort to notify the user who posted it and provide them a copy of the notice.
  • The affected user may submit a counter-notification (Section 5) if they believe the removal was a mistake or misidentification.

5. Counter-Notification

If your content was removed and you believe it was removed in error or misidentified, you may send a counter-notice to the Designated Agent that includes all of the following (required by 17 U.S.C. § 512(g)(3)):

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, the Eastern or Middle District of North Carolina) , and that you will accept service of process from the party who filed the original notice.

If we receive a valid counter-notice, we may restore the content in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

6. Repeat-Infringer Policy

Consistent with 17 U.S.C. § 512(i), ZipThrifter will, in appropriate circumstances and at its discretion, suspend or terminate the accounts of Stores, creators, or shoppers who are determined to be repeat infringers. A Store that repeatedly lists items using infringing photographs or descriptions may have listings removed, payouts held, and its account terminated.

7. Trademark, Counterfeits, and Other Takedowns

This policy covers copyright. Concerns about counterfeit goods, trademark infringement, or other prohibited items are handled under our Store Acceptable Use Policy. To report a non-copyright issue (a fake brand-name item, a trademark concern, or content that violates our rules), email help@zipthrifter.com with the listing or Store link and a description of the problem.

8. Changes to This Policy

We may update this Policy from time to time. Material changes will be posted here with an updated “Last updated” date and, where appropriate, communicated to account holders.
